General Website Terms and Conditions of Use of the Hollings Cancer Center Site (HCCS)

Please read these terms and conditions of use carefully before using this site (i.e., HCCS). By using this site, you signify your assent to these Terms and Conditions.

The Hollings Cancer Center (HCC) may revise these Terms and Conditions at anytime. Your continued usage of the HCCS will mean that you accept those changes.

Copyright: All material contained within these pages is the sole property of HCC, Medical University of South Carolina. Any reproduction or redistribution of this material is prohibited without the expressed written consent of HCC.

HCC authorizes you to view or download copies of the material on the HCCS Site solely for your personal, noncommercial use.

The Content is protected under both United States and foreign laws. Title to the Content remains with HCC or its licensors. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of HCC. All rights not expressly granted herein are reserved to HCC and its licensors.

If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

Agreement: By accessing or using this service, you agree to be bound by all of the terms and conditions below, which are intended to be fully effective and binding upon all users.

The information contained in this online site is solely intended to provide broad consumer understanding and knowledge of health care topics. Privacy policy: We respect your personal privacy. We will never release your name, street address, telephone number or e-mail address without your consent unless it is a medical emergency. In the case of a medical emergency, personal information will be released only to the proper authorities.

Usage rules: You warrant that you will not use this service for any purpose that is unlawful or prohibited by this agreement. We reserve the right to deny access to any part of this service at our sole discretion. You are personally responsible for the material that you send. Any derogatory or inflammatory information will be erased from the HCCS and your access to this site will be terminated.

Warranty disclaimer: Information accessed through this site is provided "AS IS" and without warranty, express or implied. All implied warranties of merchantability and fitness for a particular purpose are hereby excluded.

Although all medical information is reviewed by professional health care providers, the Medical University of South Carolina, and all physicians, nurses and affiliated organizations make no warranty as to the reliability, accuracy, timelines, usefulness or completeness of the information.

The provider does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise, information or service provided through the service. Except as otherwise expressly specified, the provider does not warrant the accuracy, completeness or correctness, timeliness, or usefulness of any opinions, advice, services, merchandise or other information provided through the service or on the internet in no event will the provider be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon the information provided through the service.

PPHCCS Live and Member to Member Areas ("Public Areas"): If you use a Public Area, you are solely responsible for your own communications, the consequences of posting those communications and your reliance on any communications found in the Public Areas. HCCS is not responsible for the consequences of any communications in the Public Areas. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, call your doctor or 911 immediately.

In consideration of being allowed to use the Public Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

  1. Using a Public Area for any purpose in violation of local, state, national, or international laws;
  2. Posting material that infringes on the intellectual property rights of others or on the pivacy or publicity rights of others;
  3. Posting advertisements or solicitations of business;
  4. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free form);
  5. Posting chain letters or pyramid schemes;
  6. Impersonating another person;
  7. Distributing viruses or other harmful computer code;
  8. Harvesting or otherwise collecting information about others, including email addresses, without their consent;
  9. Allowing any other person or entity to use your identification for posting or viewing comments;
  10. Posting the same note more than once or "spamming"; or
  11. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of HCC, exposes HCCS or any of its customers or suppliers to any liability or detriment of any type.
HCCS reserves the right (but is not obligated) to do any or all of the following:

  1. Record the dialogue in the information sessions.
  2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
  3. Remove communications that are abusive, illegal, disruptive, or that otherwise fail to conform with these Terms and Conditions.
  4. Terminate a user's access to any or all Public Areas and/or HCCS upon any breach of these Terms and Conditions.
  5. Monitor, edit or disclose any communication in the Public Areas.
  6. Edit or delete any communication(s) posted on HCCS, regardless of whether such communication(s) violate these standards.
HCC reserves the right to take any action it deems necessary to protect the personal safety of our guests or the public. HCC has no liability or responsibility to users of the PPHCCS or any other person or entity for performance or nonperformance of the aforementioned activities.

Web-site links: Our web site contains links to web sites operated by other parties. The links are provided for your convenience only. We do not control such web sites and are not responsible for the content and performance of these sites or for your transactions with them. Inclusion of links to such web sites does not imply any endorsement of the material on such web sites or any association with their operators.

User Submissions: You agree that you will not upload or transmit any communication or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this Site, you agree that such submission is non-confidential for all purposes. If you make any such submission, you automatically grant-or warrant that the owner of such content has expressly granted--HCCS a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium or any form format or forum now known or hereafter developed. HCCS may sublicense its rights through multiple tiers of sublicenses.

Limitations on liability: Neither the Medical University of South Carolina, nor any affiliated organizations shall be responsible for information provided herein under any theory of liability or indemnity.

The user agrees to hold harmless and indemnify the Medical University of South Carolina, all affiliated organizations, physicians, nurses, and other health care professionals from any and all claims brought against the Medical University of South Carolina, all affiliated organizations, the physicians, nurses, and other health care professionals arising from the user's use. To the maximum extent permitted by applicable law, in no event shall we be liable for any direct, special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of data, or any other pecuniary loss) arising out of or in any way connected with the use or performance of this web site, with the delay or inability to use this web site, the provision of or failure to provide services, or for any information, services and related graphics contained on or made available through this web site and the provision of or failure to provide the service, even if we have been advised of the possibility of such damages. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.

When using the HCCS, information will be transmitted over a medium, which is beyond the control and jurisdiction of HCCS. Accordingly, HCCS assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the HCCS.

Jurisdiction: This service is not targeted to users in a particular locality, nor is it intended to constitute the doing of business in any jurisdiction, nor to be a solicitation of business anywhere on behalf of the Medical University of South Carolina or any affiliate organizations, nor to constitute any contacts with any jurisdiction outside of the state of South Carolina. This agreement is entered-into and performed in the state of South Carolina, United States of America, and is governed by and shall be construed in all respects under the laws of South Carolina, exclusive of its choice of law or conflict of laws provisions. In any claim or action directly or indirectly arising under this agreement or related to the service, each party irrevocably submits to the exclusive personal jurisdiction of the South Carolina state district court sitting in Charleston County, South Carolina, or if such court does not have subject-matter jurisdiction, then each party irrevocably submits to the exclusive personal jurisdiction of the united states court for the district of South Carolina, and whichever of those two courts has jurisdiction, each party waives any jurisdictional, venue, or inconvenient forum objections to such court. If any of the provisions of this agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect. This agreement constitutes the entire agreement between the parties pertaining to its subject matter. It may not be modified except as described elsewhere in this agreement. Anything in the service inconsistent with or conflicting with the terms of this agreement is superseded by the terms of this agreement.

Complete Agreement: Except as expressly provided in a particular "legal notice" on the HCCS, these Terms and Conditions constitute the entire agreement between you and HCC with respect to the use of the HCCS, and Content. Your use of the HCCS is also subject to the HCCS Privacy Policy.
